SUMMARY:Litigation Weekend at NALSAR
DESCRIPTION:The weekend shall entail interactions and sessions with a diverse pool of litigating lawyers who shall be coming to NALSAR when it hosts the 11th Justice Bodh Raj Sawhny Memorial Moot Court Competition 2017 (organised by Moot Court Committee of SBC). Thus the event will host practicing advocates from the Supreme Court of India\, High Court of Delhi\, High Court of Hyderabad and the High Court of Bombay. \nOur event is conceptualised as an informal yet a coordinated networking and contact-building platform for the NALSAR students\, Nyaya Forum members and participants of the moot court competition. \nWe hope that the weekend shall prove to be a great learning opportunity for the students. Updates vis-a-vis the specific form of sub-events shall be posted on this event.

DESCRIPTION:Mr. Nikhil Nayyar is among the first few graduates of the NLSIU\, Bangalore to join the bar and become an Advocate on Record. A graduate of 1993\, Mr. Nayyar holds a rich experience of practicing for the last 24 years in wide variety of areas including arbitration\, company law\, constitutional law\, electricity law\, indirect taxation\, education\, labor and service law\, environmental law\, consumer protection\, land acquisition among others. Mr. Nayyar was appointed as the Additional Advocate General of Punjab and Haryana in November 2012 and held the post until recently. \nAlong with his vast knowledge and experience in practice\, he is also Honorary Editor of SCALE since 1993. \nIt is our privilege to host Mr. Nayyar from whom we will be getting insights on his experience in litigation and the challenges he faced as a first generation lawyer. We hope to see you in large numbers to hear and get inspired from a successful member of the first lot of NLU graduates.

SUMMARY:Human Rights and Courts | Talk by Dr. Colin Gonsalves
DESCRIPTION:Dr. Colin Gonsalves\, a Senior Advocate practicing at the Supreme Court is also the founder director of Human Rights Law Network (HRLN). \nSince the establishment of Human Rights Law Network in 1989\, under Dr. Gonsalves the organisation has grown from its humble roots in Mumbai into India’s leading public interest law group with over 200 lawyers and paralegals working for the group. \nDr. Gonsalves is an active litigator in the Supreme Court\, and he was instrumental in the development of the Indian People’s Tribunal\, an organisation that has published reports on various issues such as slum relocation. These reports were often the basis for many PILs filed on this issue. \nHe also represented the People’s Union for Civil Liberties as a senior counsel in the landmark case which acknowledged right to food as a legal right. He has also represented Bachpan Bachao Andolan in a matter concerning child rights\, where the apex court ordered the Union Government to effectively implement the JJ Act. \nHe is also co-founder of Combat Law\, a leading journal on human rights\, and is also a columnist for the Indian Express. Dr. Gonsalves having numerous human rights cases to his name has laid a strong testimony of the impact that we can create through litigation and its interaction with the governmental apparatus. His lecture would revolve around social change through legal machinery\, which would not only motivate students to channelize their actions for larger public interest and remind us of the power and responsibility we as aspiring lawyers need to be ready for but also be intriguing for students interested in law and society research. Through his lecture\, we at Nyaya Forum aim to imbibe what Prof (Dr) Ranbir Singh meant when he wanted legal education to be socially stimulating\, and what Prof (Dr) Madhava Menon intended by terming graduates of institutions such as ours as “social engineers.” \nThis Republic Day\, the Nyaya Forum is thrilled to host this bulwark in the field of public interest litigation and rights jurisprudence in India. \nPicture courtesy: MTFD.

Administrative Law will serve as the bait for this discussion which is also supposed to make the interaction academically and intellectually informative. \nThe talk\, both brief and anecdotal tries to present different aspects and concepts of administrative law in action in three diverse offices spaces. While studying the concept in a classroom one often wonders as to it’s relevance once you exit the academy\, the concepts do tend to be constant companions in many diverse career streams\, often in areas we never imagine. \nSidharth Sihag is a civil servant and settled in Udaipur and a part of the Rajasthan cadre. He joined IAS in 2012. \nVivek Rathore is a Principal Associate with Cyril Amarchand Mangaldas\, and specializes in Project Finance of Infrastructure. \nAakash Prasad is a litigating and arbitrating independent lawyer settled in Lucknow\, in Uttar Pradesh.

SUMMARY:Extradition Litigation | Talk with Dayan Krishnan
DESCRIPTION:Having graduated from the very first batch of the National Law School\, Mr. Dayan Krishnan happens to be from the rare class of “self-made” lawyers\, in a profession where supposedly lineage plays an instrumental role to make one’s way up. After graduating from NLS in 1993 he managed to work\, in his very first job\, under\, Santosh Hedge\, a former judge of the Supreme Court and former Solicitor General of India. Owing to the paucity of connections in Delhi and considering the nature of the profession he continued under Hedge’s guidance till 1999\, after which he set up his own practice. He was designated as a Senior Advocate in 2014 alongside Anup Bhumbhani and Amit Sibal. \nBeing selective in taking up cases was at liberty that Krishnan admittedly never had. However\, he took everything that came his way and has labelled the opportunities he got as\, “an accident or a coincidence”. Few of these “accidents” were\, his being counsel for the Kavery Kerala petition and furthermore\, his handling of the 2012 Nirbhaya Delhi Gang Rape case\, which he volunteered to do for free. On the civil side\, he specialises in telecom\, having represented S-Tel in the 2G spectrum tender notification in the Delhi High Court. \nMr. Krishnan has been engaged in the following international assigments vis-a-vis extradition law \n• Appointed as Special Public Prosecutor in the matter pertaining to the extradition of David Coleman Headley and Tahawwur Hussain Rana. (2014)\n• Appointed as Special Counsel for the Central Bureau of Investigation to represent the Government of India in the matter relating to the extradition of Mr. Varley from the United Kingdom in the Goa child sex abuse case. (2012)\n• Appointed as Special Counsel for the Central Bureau of Investigation to represent the Government of India for the extradition of Ravi Shankaran from the United Kingdom. (2011)\n• Appointed as Special Counsel for the National Investigation Agency to be member of a four-member team which visited Chicago to interrogate David Coleman Headly\, one of the accused in the terrorist attacks in Mumbai on 26.11.2008. (2010) \nOn his trip to the Justice City\, he is keen to explore and elucidate upon matters pertaining to extradition law owing to the lack of discussion around it. India has about 110 extradition requests pending in several countries and in the recent past\, various countries have been awfully meddling and troublesome in handing fugitives over. SUMMARY:Litigating 'Public Interest' | A Book Discussion
DESCRIPTION:Nyaya Forum and NALSAR Lecture Series on Constitutionalism bring to you a discussion on a recent publication on Public Interest Litigation. The proceedings shall touch on what PIL has come to be in the recent years\, and would be of special interest to those interested in public law\, constitutionalism\, and litigation at higher courts in India. \nThe Indian higher judiciary has acquired an increasingly important role in India’s public discourse in the last few decades. The Supreme Court and the state High Courts have emerged as enormously powerful judicial institutions in the aftermath of the Internal Emergency of 1975-77. The principal means through which these judicial powers have been mobilized and enacted is the jurisdiction of Public Interest Litigation (PIL). This book studies the political role that PIL has come to play in contemporary India. It revisits the circumstances and manoeuvres that led to the rise of PIL and traces its political journey since then\, arguing that the enormous powers that PIL confers upon the appellate judiciary stems from its populist character. \nBased on empirical research\, it shows how PIL grants the appellate courts enormous flexibility in procedure allowing them to manoeuvre themselves into positions of overweening authority. It focuses on the most intensive laboratory of PIL in recent times\, the city of Delhi\, and foregrounds the role that PIL has played in the radical reconfiguration of the city in the 21st century. While PIL cases are usually politically analysed solely in terms of their effects\, whether beneficial or disastrous\, this book locates the political challenges that PIL poses in its very process: arguing that its fundamentally protean nature stems from its mimicry of ideas of popular justice. \nCourting the People examines PIL as part of a larger trend towards legal informalism in post-Emergency India. Casting a critical eye at these institutional reforms that aimed to adapt the colonial legal inheritance to ‘Indian realities’\, this book looks at the challenges posed by self-consciously culturalist juridicial innovations like PIL to ideas of fairness in adjudication as well as democratic politics. \nMs. Vasudha Nagarajan is an Advocate\, practicing at the the High Court of Judicature for the States of Telangana and Andhra Pradesh\, Hyderabad. She shall be acting as a discussant for the event. SUMMARY:On Judging | Talk by Justice K. Kannan
DESCRIPTION:Justice K. Kannan is a former judge\, High Court of Punjab & Haryana\, Chandigarh and at High Court of Madras. He was elevated as a judge in 2008. He has authored and edited several books on law from 2002. A trained mediator\, Justice Kannan blogged for a while with a reasonable public following before dropping out due to professional compulsions. His principled declaration of assets as the first judge in India brought a new paradigm for the entire judiciary to follow\, and the weekly India Today named him among twenty heroes of 2009. He retired from judgeship in June 2016. Presently he is the Chairman of Railway Claims Tribunal at its Principal Bench at New Delhi. \nApart from an avid interest in medicine and law as an inter-disciplinary approach\, he is also an expert in liability and succession laws. He has written a book on Accidents and Compensation Law (Wadhwa Butterworths LexisNexis\, 2005) and contributed to two titles of the Halsbury’s Laws of India\, Wills and Succession and Landlord and Tenant (both 1st and 2nd editions). He is the editor of the renowned Modi’s Text Book on Medical Jurisprudence and Toxicology\, 2016 edition\, Mulla’s Indian Registration Act\, Mulla’s Sale of Goods Act and Partnership Act (Students’ edition)\, Paruck’s Indian Succession Act (the last 3 editions). \nFali Nariman’s “unsolicited suggestion” that a “citadel never falls except from within” can be also directed to those who were once (but are no more) under that citadel. It is always challenging to understand and come to terms with the ways of judicial institution building\, and its functioning. It’s not always very similar to other governmental (executive or legislative or administrative) apparatus. It has its own very peculiar features. \nThus\, as a person imbibing the high held virtues and proprieties of judicial office\, Mr. Kannan’s lecture will surely benefit students at Justice City to understand the same. SUMMARY:My Innings in Justice: Talk by Justice Mukul Mudgal
DESCRIPTION:Justice Mukul Mudgal started his practice as an advocate in the Delhi High Court and the Supreme Court in 1973. In 1998\, he was appointed as a Judge in the Delhi High Court. He then went on to become the Chief Justice of the Punjab and Haryana High Court in 2009\, after which he retired in 2011. Currently\, he is a member of National Legal Services Authority (NALSA) and Court of Arbitration for Sport (CAS)\, Geneva. \nJustice Mudgal has been pivotal in the drafting of two bills that could potentially have immense impact in the field of sports – the National Sports Development Bill\, 2013 and the Prevention of Sporting Fraud Bill\, 2013. In addition\, in 2014 the Supreme Court appointed him to investigate allegations of spot-fixing\, corruption and betting in the hugely popular 2013 Indian Premier League cricket matches\, by heading the Mudgal Committee. Justice Mudgal has been vocal about bringing the BCCI under the ambit of the Right to Information (RTI) Act. Another sport Justice Mudgal is involved with is football – FIFA has appointed him as the Deputy Chairman of its Governance Committee. \nSome noteworthy cases Justice Mudgal has adjudicated or has otherwise been involved in are Vishakha v. State of Rajasthan; Sunil Batra v. Delhi Administration (notable for laying down prison reforms); and Jagdish & Others v. Delhi Development Authority (where the resettlement of 200 inhabitants of slums forcibly evicted by the DDA was ordered). \nJudge Mudgal is well-known not only for his work inside the court\, but even beyond it. With reference to his role in investigating the 2013 IPL\, and his profound love for cricket (as we have come to infer it)\, it is intriguing how one can fulfil his/her interests while being in the bar and the bench\, and later on after superannuation. His lecture would be of immense interest to those who are caught mingling interests in academics and extra-curricular activities; and could provide them to come up with a proper balance in their lives. \nHe will als be talking about sports regulation\, issues such as betting and gambling inter alia.

SUMMARY:Confessions of an Accidental Lawyer | Talk by Dr. Aditya Sondhi
DESCRIPTION:Dr.Aditya Sondhi graduated from NLSIU Bangalore in 1998\, and made a humble beginning into the world of litigation. His hard work paid dividends when he was designated a Senior Advocate at Karnataka High Court in 2014. He is among the first few NLS graduates to be designated as a Senior. He has recently been appointed as an Additional Advocate-General of Karnataka State. Apart from his courtroom avatar\, he is also a Visiting Professor at his alma mater\, NLS and teaches Constitutional Law\, Company Law\, Professional Ethics and Arbitration. \nHis “confessions\,” as he describes the nature of his revelations\, shall revolve around the three major transitions in his life. First\, his steps into the courtroom just after graduation as a young lawyer. Second\, when he was designated as a Senior at the Karnataka High Court in June\, 2014. Third\, his transition from private practice to being in the shoes of a State Counsel\, which came when he was appointed as the Additional Advocate-General of the State of Karnataka in this very year. \nHe has continued to quench his thirst for knowledge by gaining as much education as possible. He has been awarded a PhD in Political Science by the Mysore University.
